KFS says Muthaiga Golf Club has no proof it owns 21.8 hectares of Karura Forest.
The Kenya Forest Service says Muthaiga Golf Club has produced no evidence that it legally occupies about 21.8 hectares of Karura Forest, and that the club's recent claims "may imply grabbing of public land by private interest".
The dispute is over Land Reference Number 13134/3. KFS says the parcel encroaches on the gazetted forest by roughly 21.8 hectares. Its officers have restricted access to the club's Front Nine, holes two to nine, and the club has closed those holes to members.
What each side says
KFS says Karura, 1,044.1 hectares in all, was surveyed in the early 1920s, registered in 1923, declared a forest reserve under Proclamation No. 44 of 1932 and gazetted as a Central Forest under Legal Notice No. 174 of 20 May 1964. A 1966 plan showed the extent of the land the club leased, and in 1974 the Chief Conservator approved a boundary extension northward. "There is no evidence of record to the effect proving legal occupation of the forest by the Club," KFS said, adding that the club never applied for a Forest Special Use Licence under the 2007 forest law.
The club says it holds a title deed, which its representatives presented when KFS first invited them to discuss the occupation in 2021. The club has accused KFS of invading its course.
What next
The two sides have agreed to meet at KFS headquarters to try to reconcile their positions. No date has been given. Until then the Front Nine stays restricted.
