Court upholds Nubian community’s title to 288 acres of Kibera.
The Environment and Land Court has upheld the Kibra Nubian Community Land Trust's title to 288 acres of Kibera, according to Business Daily.
The land is held under Grant IR 149108, allocated to the community trust in 2017 as redress for historical injustice.
The petition to cancel it was brought by the Kibera Lindi Friends and Neighbours Welfare Association and Bukhungu CBO 047. The respondents included the Attorney-General, the Cabinet Secretary for Lands, the National Land Commission and Nairobi City County.
The court found the petitioners had not shown ownership rights, holding that mere occupation is not enough to attract constitutional protection, and that the original allocation had followed lawful procedure including gazette notices, advertisements and public participation.
It also rejected a Sh10 billion compensation claim, finding no valuation reports or supporting evidence had been produced.
The dispute goes back to the early 1900s, when British colonial authorities settled former Sudanese soldiers and their families in Kibra after military service. The Nubian community won a related ruling at the African Commission on Human and Peoples' Rights in a case running from 2006.
The same title is the subject of other live litigation, including a 2023 case brought by the Nubian Rights Forum and a land case filed in 2025.
