Lady Justice M. Thande held that the IEBC's plan to hold the next General Election on August 10, 2027 is based on an incorrect interpretation of the Constitution. She declared that the date of the presidential election is predetermined by the Constitution and is not subject to the electoral commission's discretion.
Background
The provision at the centre of this dispute is short. Article 101 of the Constitution states that a general election is held on the second Tuesday in August in every fifth year. Read on its own, that language sets a repeating calendar rather than a date to be chosen, and it was drafted deliberately to take the timing of elections out of the hands of whoever holds office.
The complication is how the five years are counted after an election cycle that did not run to the standard pattern. Kenya has had a nullified presidential election and a repeat poll within a single cycle, and swearing-in dates have not always fallen where a clean reading of the calendar would put them. Different starting points produce different answers, and because the presidential term is defined separately from the election date, a shift in one does not automatically move the other. That is the gap an interpretation of this kind opens up.
Why it matters here
A change in the election date would move every county and parliamentary contest with it, including Kibra’s. It would compress or extend voter registration, party primaries, boundary confirmations and the electoral commission’s procurement of ballot materials, all of which are already tightly sequenced. It would also affect the terms of sitting governors, senators, MPs and ward representatives, which is why rulings of this type are almost always appealed.
What to watch next
Expect an appeal, a possible referral to a larger bench given the constitutional questions involved, and a formal position from the electoral commission on whether its published timetable stands pending that appeal. Until an appellate court rules, the commission’s existing calendar is the operative one for planning purposes.
